ISLANDER ADVENTURE CO - TERMS AND CONDITIONS
By using this website and/or purchasing tours or transport services from Islander Adventure Co and/or participating in a tour or transport service operated by Islander Adventure Co, you agree to the following Terms & Conditions.
1. Copyright & Terms of Use
Copyright © CS & LJ Burgess Pty Ltd (ABN 61 676 034 156) trading as Islander Adventure Co, referred to in these terms and conditions as 'Islander Adventure Co', 'Islander', 'we', 'us' or 'our'.
The following information applies to:
The Islander Adventure Co website (www.islanderadventureco.com.au); and
All persons participating in a tour or transport service operated by Islander Adventure Co.
Our website, its content, text, images and associated material is owned and copyrighted by Islander Adventure Co. By accessing the website, you agree to be bound by these terms of use. Islander Adventure Co reserves the right to change these terms and conditions from time to time at its sole discretion.
You are permitted to view, copy, print and distribute the information contained in our website for personal, non-commercial purposes subject to your agreement that you will not modify the information or graphics and you will display the copyright notice on all information.
Printing or distributing the information contained in this website for commercial purposes is strictly forbidden without prior written consent, which can be obtained by email islanderadventureco@gmail.com.
Our website may contain links to third party websites which are not under the control of Islander Adventure Co. A link to another website should not be taken as our endorsement of the content as we are not responsible for the content of any third party websites.
2. Privacy Policy
Islander Adventure Co respects and protects the privacy of our guests and visitors to our website and tours.
All information collected is processed in accordance with the Australian Privacy Principles, established under the Privacy Act 1988. The information provided by you when you make a booking or make an enquiry through our website ("Personal Information") and any other information sent to us by you or otherwise obtained by us about you is only used for the purposes of:
Responding to your enquiry;
Processing your booking;
Providing a personalised service;
Providing you with goods and services you have requested;
Fulfilling our obligations under law;
Assessing and evaluating how visitors use the website.
Although Islander Adventure Co may share general information about our website visitors and guests with third parties, this data is collated into aggregate measures and contains no details which could identify specific individuals. For example, we may use analytics tools to report on statistical information about our website visitors including time spent on website, the pages viewed, location, technology, and demographics, but this does not contain any personally identifiable information.
If you travel on one of our tours or transport services or make a payment to us, we are required by law to keep a record of passenger details and financial transactions. You can be assured that individually identifiable information is not disclosed to any third party for any purpose other than dealing with a purchase or enquiry from you, or fulfilling our obligations under law.

3. Pricing Currency & GST
All prices are in Australian Dollars (AUD) and include GST and may change from time to time.
4. Bookings are Subject to Availability
All bookings are private and subject to availability of vessel, vehicle, and crew.
Bookings are also subject to safe weather and sea conditions. If weather or sea conditions are deemed unsafe by the Master or driver, we will make every effort to reschedule your experience to an alternative date and time that suits you. If rescheduling is not possible, you will receive a full refund.
We reserve the right to decline bookings where the requested itinerary or timing presents safety concerns or is not operationally feasible.
5. Cancellation Policy
We understand that travel plans can change. However, as all our experiences are private bookings, cancellations impact our ability to accommodate other guests. Please contact us as soon as possible if you need to cancel your booking.
5.1 Guest-Initiated Cancellations
A 20% deposit is required to confirm your booking. The remaining 80% balance is due on the day of departure.
Standard cancellations:
Cancellations made more than 14 days before departure: Full refund of deposit
Cancellations made within 14 days of departure: Deposit is retained by operator
Weather-related travel disruptions: If you are unable to reach Bruny Island due to documented weather disruptions (flight cancellations, ferry closures, road closures), contact us immediately. We will provide a full refund of your deposit upon verification of the disruption. This applies to weather events preventing your travel to us, not general poor weather conditions at the destination.
5.2 Islander-Initiated Cancellations
Weather and sea conditions: If we determine that weather or sea conditions are unsafe for your scheduled experience, we will contact you to reschedule to an alternative date and time that suits you. If rescheduling is not possible or does not suit your travel plans, you will receive a full refund of your deposit.
Other circumstances: If we need to cancel your booking due to mechanical issues, crew unavailability, or other operational reasons, you will receive a full refund of your deposit or the option to reschedule.
6. Variation of Tours and Transport Services
We reserve the right to cancel or vary any tour or transport service due to weather conditions, sea state, mechanical issues, insufficient bookings, or other circumstances beyond our control. We will incur no liability for any such cancellation or alteration beyond providing a refund or alternative booking as outlined in Section 5.
The Master of the vessel (for maritime services) or the driver (for land-based services) has the sole and absolute discretion to vary the scheduled route or destination if they consider it necessary for the safety and welfare of the vessel/vehicle, its passengers and crew.
7. Product Refund Policy
If you purchase clothing, souvenirs, or other retail merchandise from us or our partners, we are not required to provide a refund or replacement if you change your mind. However, in the event of a fault with an item, we will either exchange, refund or replace the item in accordance with the requirements of the Australian Consumer Law. Please keep your proof of purchase (e.g., a receipt).
Please note that gift vouchers cannot be refunded or redeemed for cash. Lost gift vouchers cannot be reissued or replaced.
8. Maritime Transport Services
8.1 The Master
Islander Adventure Co's vessels are operated under the absolute direction and control of the Master (Coxswain) at all times, in accordance with the Domestic Commercial Vessel National Law.
The Master of the vessel has the sole and absolute discretion to:
Vary the scheduled route or destination of the tour or transport service;
Refuse boarding to any passenger;
Require any passenger to disembark;
Make any decision they consider necessary for the safety and welfare of the vessel, its passengers and crew.
By boarding Islander Adventure Co's vessel, you agree to comply with all reasonable requests made by Islander Adventure Co and/or the Master of the vessel, at all times.
8.2 Passenger Conduct While Aboard Vessel
Islander Adventure Co is committed to the safety and wellbeing of all passengers, crew, and other personnel on board our vessels. All passengers must comply with these terms and conditions and obey any reasonable request of the Master of the vessel and any member of the crew.
Offensive behaviour will not be tolerated. This includes conduct that is a nuisance, dangerous activity or offensive in any way that interrupts the enjoyment of the experience for other persons. If a passenger behaves in a way that negatively impacts others, Islander Adventure Co reserves the right to take all reasonable steps to remove the offending passenger from our vessel at their expense, notify the relevant authorities to receive the offending passenger onshore to be dealt with accordingly, and may record the offending passenger's details on our Incident Register.
8.3 Safety Requirements for Maritime Services
All passengers must:
Wear provided personal flotation devices (PFDs/life jackets) when required by the Master;
Follow all safety briefings and instructions;
Remain seated when the vessel is underway unless given permission by the Master or crew;
Not consume alcohol or be under the influence of illicit drugs or impairing medications while aboard;
Notify the Master or crew immediately if they feel unwell;
Not interfere with any safety equipment or vessel operations.
Children must be supervised by a responsible adult at all times while aboard the vessel and during embarkation and disembarkation.
9. Land-Based Tours and Bus Transport Services
9.1 Driver Authority
Islander Adventure Co's buses/vehicles are operated under the absolute direction and control of the driver at all times.
The driver has the sole and absolute discretion to:
Vary the scheduled route or destination;
Refuse boarding to any passenger;
Require any passenger to disembark;
Make any decision they consider necessary for the safety and welfare of the vehicle, its passengers and other road users.
By boarding Islander Adventure Co's bus/vehicle, you agree to comply with all reasonable requests made by Islander Adventure Co and/or the driver, at all times.
9.2 Passenger Conduct on Land-Based Services
All passengers must comply with these terms and conditions and obey any reasonable request of the driver.
Offensive behaviour during a tour or transport service (including when on the bus/vehicle and at all other times during the service) will not be tolerated, including any conduct that is a nuisance, dangerous activity or offensive in any way that interrupts the enjoyment of the experience for other persons. If a passenger behaves in a way that negatively impacts others, Islander Adventure Co reserves the right to take all reasonable steps to remove the offending passenger from our bus/vehicle/tour at their expense, notify the relevant authorities and may record the offending passenger's details on our Incident Register.
9.3 Safety Requirements for Land-Based Services
All passengers must:
Wear seatbelts when provided and when required by law;
Follow all safety instructions from the driver;
Remain seated when the vehicle is in motion;
Not consume alcohol or be under the influence of illicit drugs while aboard;
Not distract the driver while the vehicle is in motion.
Children must be appropriately restrained in accordance with Tasmanian road safety laws and supervised by a responsible adult at all times.
10. Pickup and Drop-off Locations
10.1 Maritime Transport Services
Islander Adventure Co provides maritime transport services from designated mainland pickup locations (including but not limited to Kettering and Margate) via vessel to North Bruny Island, and return services.
10.2 Land-Based Transport Services
Islander Adventure Co provides land-based transport services on Bruny Island, with pickup and drop-off locations confirmed at time of booking based on your specific itinerary. For events such as weddings or group bookings, designated pickup points will be specified in your booking confirmation.
10.3 Passenger Responsibilities
Passengers must:
Arrive at the designated pickup location at the specified time;
Notify Islander Adventure Co immediately if they will be late or unable to make the scheduled departure;
Follow all instructions regarding boarding procedures and timing.
Islander Adventure Co reserves the right to depart without passengers who have not arrived by the scheduled departure time. Standard cancellation fees as outlined in Section 5 will apply.
11. Risk - Liability for Personal Injury or Loss or Damage to Property
Islander Adventure Co draws your attention to the fact that there are inherent risks present when participating in maritime and land-based tours and transport services, including but not limited to:
Maritime risks: vessel movement, sea conditions, weather changes, embarkation/disembarkation from vessels, exposure to marine environment;
Land-based risks: vehicle movement, road conditions, weather, embarkation/disembarkation from vehicles, uneven terrain during tours.
If Islander Adventure Co advises you of a risk and/or instructs you on precautionary measures while on tour or during transport, you agree to follow those instructions.
11.1 Personal Belongings
All personal belongings will be your responsibility. Where consumer laws and other laws permit Islander Adventure Co to exclude its liability, we will not be liable for loss of, or damage to, any luggage, property or other belongings.
11.2 Personal Injury - Maritime Services
To the extent permitted by law, Islander Adventure Co, its owner, directors, management staff and employees shall not be held responsible for sickness, injury or death occurring:
During embarkation and/or disembarkation to or from the vessel;
At any time whilst aboard the vessel itself;
As a result of sea conditions, weather, or vessel movement;
EXCEPT where caused by wilful misconduct or reckless disregard by Islander Adventure Co, its Master, crew or personnel.
Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
11.3 Personal Injury - Land-Based Services
To the extent permitted by law, Islander Adventure Co, its owner, directors, management staff and employees shall not be held responsible for sickness, injury or death occurring:
During boarding and/or alighting from a bus/vehicle;
At any time whilst aboard the bus/vehicle itself;
During the course of a tour or transport service;
EXCEPT where caused by wilful misconduct or reckless disregard by Islander Adventure Co, its drivers or personnel.
Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
11.4 Burden of Proof
In the event of an incident occurring during the course of any service resulting in personal injury or loss or damage, and where liability is disputed, you will be responsible to prove that your personal injury or loss or damage was the fault of Islander Adventure Co or its personnel, to the extent permitted by law.
11.5 Medical Fitness
By agreeing to these terms and conditions, you are certifying that:
You are medically and physically fit and able to participate in Islander Adventure Co's tours and transport services;
You will not participate under the influence of any illicit drugs, or any prescription medication which would in any way impair your ability to safely participate;
You have disclosed any medical conditions, mobility limitations, or other circumstances that may affect your safe participation;
You understand and accept the physical demands and inherent risks associated with the specific tour or transport service you have booked.
If you have any medical conditions, disabilities, or special requirements, you must notify Islander Adventure Co at the time of booking so appropriate arrangements can be made.
12. Photography / Video
By participating in a tour or transport service operated by Islander Adventure Co, you acknowledge that your image may be captured by cameras controlled by Islander Adventure Co, our partners, or other passengers, whether photographic or video, which may be used in promotional material or shared across social media.
By participating in a tour or transport service operated by Islander Adventure Co, you agree that your image may be shared on social media or other platforms and release Islander Adventure Co from any liability in relation to the sharing of those photographs/videos.
If you do not wish to be photographed or filmed, please notify Islander Adventure Co staff at the beginning of your tour or transport service.
13. Food and Beverage Services
Where Islander Adventure Co provides food and beverage services as part of a tour (including but not limited to the Bruny Island Wild Long Lunch experience), you acknowledge that:
Menu items and beverage selections may vary based on seasonal availability and supplier changes;
We will make reasonable efforts to accommodate dietary requirements if notified in advance at time of booking;
We cannot guarantee a completely allergen-free environment;
You are responsible for making us aware of any food allergies, intolerances, or dietary restrictions at the time of booking.
14. Private Charters
Private charter bookings may be subject to additional terms and conditions, including:
Minimum and maximum passenger numbers;
Specific itinerary requirements;
Customized cancellation policies;
Additional fees for route variations or extended duration;
Specific safety requirements for the planned itinerary.
All private charter bookings will be confirmed in writing with specific terms outlined in the booking confirmation.
15. Age Restrictions and Supervision Requirements
Minimum age requirements may apply to certain tours and transport services based on safety considerations.
Children under 18 years of age must be accompanied by a responsible adult at all times during tours and transport services.
Parents and guardians are responsible for:
Ensuring children follow all safety instructions;
Supervising children during embarkation, disembarkation, and while aboard vessels or vehicles;
Ensuring children wear required safety equipment including PFDs and seatbelts.
16. Insurance
Islander Adventure Co maintains appropriate public liability insurance and marine liability insurance in accordance with legal requirements. However, we strongly recommend that all passengers obtain their own travel insurance covering:
Personal injury and medical expenses;
Loss or damage to personal belongings;
Trip cancellation or interruption;
Any other risks associated with travel and adventure tourism activities.
Islander Adventure Co is not responsible for any costs or expenses incurred due to inadequate personal travel insurance coverage.
17. Special Requirements and Accessibility
If you have any special requirements, including but not limited to:
Mobility limitations or disabilities;
Medical conditions that may affect your participation;
Dietary restrictions or food allergies;
Language barriers;
You must notify Islander Adventure Co at the time of booking so we can assess whether we can accommodate your needs safely and appropriately.
While we strive to make our services accessible, some tours and transport services may not be suitable for all passengers due to the nature of maritime operations and the physical demands of certain activities.
18. Alcohol and Drugs
Passengers must not:
Board any vessel or vehicle while intoxicated or under the influence of illicit drugs;
Consume alcohol during maritime transport services (alcohol may be provided as part of specific tour experiences only);
Bring their own alcohol aboard unless explicitly permitted as part of a private charter agreement;
Use or possess illicit drugs at any time during tours or transport services.
Islander Adventure Co reserves the right to refuse boarding or remove any passenger who is intoxicated, under the influence of drugs, or whose behaviour poses a safety risk to themselves or others. No refund will be provided in such circumstances.
19. Weather and Sea Conditions
Maritime services are subject to weather and sea conditions. The Master of the vessel has sole discretion to:
Cancel or postpone a departure;
Return to port early;
Modify the route or itinerary;
Make any other decision necessary for passenger and vessel safety.
While we monitor weather forecasts and sea conditions carefully, conditions can change rapidly. Passengers should be prepared for:
Vessel movement and potential seasickness;
Spray and exposure to wind;
Changes to scheduled itineraries;
Potential cancellations with minimal notice.
If you are prone to seasickness, we recommend taking appropriate medication before departure.
20. Activities During Tours
During our tours, we may stop at beaches, lookouts, bushwalking trails, and other locations where you have the opportunity to explore, swim, or engage in other activities.
You acknowledge and agree that:
Any swimming, bushwalking, beach access, or other activities you choose to undertake during tour stops are at your own risk;
Islander Adventure Co is not responsible for supervising or monitoring your activities during these stops;
You are responsible for assessing your own ability and the safety of conditions before engaging in any activity;
You should follow all posted warnings, signs, and safety information at these locations;
Natural environments present inherent risks including but not limited to: uneven terrain, slippery surfaces, marine hazards, wildlife, changing weather conditions, and remote locations with limited emergency services access.
Parents and guardians remain responsible for supervising children at all times during tour stops and activity periods.
We will provide information about estimated stop durations and any known hazards, but the decision to participate in any activity remains yours.
21. Complaints and Feedback

We aim to do our best to resolve your complaint by the end of the third business day after the day we receive it (excluding weekends).
22. Jurisdiction
Any dispute or claim arising out of or in connection with any tour or transport service operated by Islander Adventure Co shall be governed and construed in accordance with the laws of Tasmania, Australia.
23. Severability
If any provision of these terms and conditions is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect.
24. Entire Agreement
These terms and conditions constitute the entire agreement between you and Islander Adventure Co regarding your participation in our tours and transport services, and supersede any prior agreements or understandings.
