  1. ABOUT THIS POLICY

Islander Adventure Co ("we", "us", "our") respects your privacy. This policy explains what personal information we collect, why we collect it, how we use and protect it, who we share it with, and what rights you have.

This policy applies to:

  • Visitors to our website, www.islanderadventureco.com;

  • People who make an enquiry or booking with us;

  • Passengers on our maritime and land-based tours and transport services; and

  • Anyone else who provides personal information to us.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We do this as a matter of choice as well as obligation: we apply these standards to all personal information we hold, regardless of whether we are strictly required to.

2.WHAT PERSONAL INFORMATION WE COLLECT

The information we collect depends on how you interact with us.

2.1 Information you give us

Identity and contact details: name, email address, phone number, postal address and country of residence, of the person making the booking.

Booking details: dates, group size, itinerary preferences and pickup location.

Payment details: payment card details, billing address and transaction records.

Health and safety information: medical conditions, mobility limitations, allergies and dietary requirements affecting anyone in your group, and emergency contact details.

Correspondence: enquiries, complaints, feedback and reviews.

Marketing preferences: newsletter subscriptions and marketing preferences

We do not keep a passenger list. For each trip we record the number of passengers on board, not their names (see Section 6.2).

2.2 Information we collect automatically

  • Device and browser type, operating system, and screen size;

  • IP address and approximate location derived from it;

  • Pages viewed, time spent on the site, and how you arrived at our site;

  • Cookies and similar technologies (see Section 5).

2.3 Images and recordings

We may take photographs and video during tours and transport services. Where you are identifiable in an image, that image is personal information. We handle images in accordance with Section 8.

2.4 Group bookings

Our experiences are usually booked by one person on behalf of a group. If you are that person, we will hold your name and contact details, but we do not ask for the names or contact details of the other people in your group, and we do not keep a passenger list.

If you tell us about a medical condition, allergy, mobility need or dietary requirement affecting someone else in your group, you must have their permission to do so, and you should make sure they have seen this policy. We keep that information only for as long as we need it to carry your group safely (see Section 6.1).

2.5 Information from third parties

We may receive personal information about you from:

  • Our online booking platform;

  • Payment processors;

  • Travel agents, tour resellers, or wedding and event planners who book on your behalf.

3.WHY WE COLLECT AND USE YOUR INFORMATION

We collect and use personal information to:

  • Respond to your enquiries, by answering your questions and providing quotes;

  • Process your booking, by confirming it, taking payment, and issuing receipts and tickets;

  • Deliver the service, by coordinating pickups, itineraries, catering and crew;

  • Keep you safe, by recording passenger numbers, holding emergency contact details, responding to incidents, and accommodating medical conditions and mobility needs;

  • Meet our legal obligations, including maritime trip logs, financial and tax records, and incident reporting;

  • Provide customer service, by handling complaints and feedback;

  • Send you marketing, where you have consented;

  • Understand how our website is used, so we can improve it;

  • Establish, exercise or defend a legal claim, and deal with our insurers.

We will not use your personal information for a purpose unrelated to those above without telling you and, where required, obtaining your consent.

3.1 We only collect what we need

We collect only the personal information we genuinely need in order to carry your group safely, process your booking, and meet our legal obligations. In particular:

  • We do not keep a passenger list. We record the number of passengers on each trip, not their names;

  • We hold the name and contact details of the person who makes the booking, and generally no one else in the group;

  • We ask for medical, mobility and dietary information only where it affects how we carry you safely or what we serve you, not as a matter of routine;

  • We do not collect personal information simply because it might be useful later.

4.WHO WE SHARE YOUR INFORMATION WITH

We do not sell your personal information. We share it only in the following circumstances.

4.1 Service providers

We use third parties to help us run our business. These may include:

  • Our online booking and reservation platform;

  • Payment processors;

  • Email, cloud storage and accounting providers;

  • Website hosting and analytics providers;

  • Catering, hospitality and other tour partners, where they form part of your experience.

We share only what these providers need in order to perform their function, and we require them to protect your information and to use it only for the purpose we have engaged them for.

The specific providers we use may change from time to time. If you would like to know which providers we currently use and where they are located, email us at islanderadventureco@gmail.com and we will tell you.

4.2 Other disclosures

  • Emergency services, medical personnel, or maritime authorities, where necessary to protect someone's life, health or safety;

  • Regulators or law enforcement, where required or authorised by law;

  • Our insurers and professional advisers, where relevant to a claim or incident;

  • A purchaser of our business, if we sell it, on the basis that they must handle your information in accordance with this policy.

4.3 Overseas disclosure

Many of the providers used by businesses like ours store or process information outside Australia. This means some of your personal information is likely to be stored or accessed overseas, most commonly in the United States, but potentially in other countries depending on the providers we use at the time.

Where we disclose your information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles. However, by providing your personal information to us, you consent to this overseas disclosure and acknowledge that Australian Privacy Principle 8.1 will not apply to it. This means we will not be accountable under the Privacy Act for how the overseas recipient handles your information, and you may not be able to seek redress under the Privacy Act in respect of that handling.

5.COOKIES AND WEBSITE TRACKING

Cookies are small files placed on your device by a website. Similar technologies include pixels, tags, and local storage. We refer to all of these as "cookies" below.

The cookies we may use fall into three categories:

Essential cookies make the site work, for example by keeping your booking in the cart while you complete it. These cannot be switched off.

Analytics cookies tell us how people use our site, including pages viewed, time on site, and how visitors found us, so that we can improve it. These do not identify you personally to us.

Advertising cookies allow us to show you our advertising on other platforms and to measure whether that advertising worked. These may involve sharing information with advertising platforms.

We use essential cookies at all times. We use analytics cookies where they are enabled on our site.

We do not currently use advertising or tracking cookies. If we introduce them, we will update this policy and we will ask for your consent before setting them. We will not set advertising cookies without giving you the opportunity to decline.

You can control or block cookies through your browser settings at any time. Blocking essential cookies may stop parts of our site from working properly.

6.HOW WE STORE AND PROTECT YOUR INFORMATION

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These include:

  • Restricting access to personal information to those who need it;

  • Using reputable providers with their own security controls;

  • Using password protection and secure cloud storage;

  • Not storing full payment card details ourselves, as payments are processed by our payment provider;

  • Storing trip logs and incident records securely, in accordance with our Safety Management System.

No method of transmission or storage is completely secure. While we take reasonable steps, we cannot guarantee absolute security.

6.1 How long we keep it

We keep personal information only for as long as we need it, or for as long as the law requires us to. Our retention periods are set out in our Safety Management System and summarised below.

Trip logs (date, route, vessel, master, number of passengers, conditions): kept indefinitely. These are operational safety records. They record how many people were on board, not who they were, so they do not identify you.

Incident and near-miss reports: kept for at least 7 years, and longer where a claim or investigation is ongoing or our insurer requires it. These may name individuals where an incident involved them.

Medical, dietary, mobility and accessibility information: deleted within 30 days of your experience, unless it is needed in connection with an incident or claim.

Financial and transaction records: kept for at least 5 years, as required by tax law. We cannot delete these on request during that period.

Booking and contact details, beyond what is needed for financial records: kept while our relationship with you is active, and generally up to 3 years after your last booking. Deleted sooner if you ask us to.

Marketing contacts: kept until you unsubscribe, ask us to delete them, or after a long period of inactivity, generally 3 years.

Enquiries that do not become bookings: kept for 12 months from your last contact with us. If you also opted in to our marketing, we keep your marketing contact details separately until you unsubscribe.

When we no longer need your personal information, we will destroy it or de-identify it.

6.2 Maritime safety records

We operate a domestic commercial vessel under the Marine Safety (Domestic Commercial Vessel) National Law. We are required to maintain a Safety Management System, which includes keeping a log of every trip

Our trip log records the date, route, vessel, master, the number of passengers on board, and the conditions. It does not record passenger names. We are not required to keep a passenger list, and we do not keep one.

If there is an incident in Tasmanian waters, the Australian Maritime Safety Authority, Marine and Safety Tasmania, or the Australian Transport Safety Bureau may ask us to produce our records, and we are obliged to do so.

6.3 Data breaches

If we become aware of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breach scheme.

7.YOUR RIGHTS

7.1 Access and correction

You may ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong. Email islanderadventureco@gmail.com. We will:

  • Acknowledge your request promptly;

  • Respond within 30 days;

  • Provide the information free of charge. We may charge a reasonable fee for large or complex requests, and will tell you before we do.

We may need to verify your identity before releasing information. In limited circumstances we may refuse a request. If we do, we will tell you why in writing and explain how to complain.

7.2 Deletion

You may ask us to delete your personal information at any time by emailing islanderadventureco@gmail.com. We will do so, except where:

  • The law requires us to keep it, most importantly financial and transaction records, which we must keep for at least 5 years;

  • It forms part of an incident or near-miss report, which we retain under our Safety Management System so that we can respond to any safety investigation or claim;

  • We need it in connection with an insurance claim or legal claim.

Where we cannot delete something, we will tell you why, and we will delete everything else we are able to, including your marketing and contact records. We will also stop using the retained information for any purpose other than the one that requires us to keep it.

7.3 Marketing opt-out

We will only send you marketing communications if you have consented. Every marketing email includes an unsubscribe link, and we will action unsubscribe requests within 5 business days. You can also email us at any time to opt out.

7.4 Anonymity

You can browse our website without identifying yourself.

If you are travelling as part of a group, we generally will not hold your name at all, as we deal with the person who made the booking. We do not keep a passenger list.

The person who makes the booking does need to give us their name and contact details, so that we can confirm the booking, take payment, and reach them if conditions change.

8.PHOTOGRAPHY AND VIDEO

We take photographs and video during tours and transport services, both to share with you and to promote our business

  • We will askfor your consent before using any image in which you are identifiable in our marketing, on our website, or on social media.

  • You can give or withhold that consent when you book, and you can change your mind at any time.

  • If you ask us to remove an image of you from our channels, we will do so promptly.

  • We may take photographs and video for operational and safety purposes, for example recording an incident or documenting conditions, regardless of your marketing consent. We use these only for those purposes.

  • Other passengers may take their own photographs. We are not responsible for images taken or shared by other passengers, but we ask all guests to be respectful of each other's privacy.

9.CHILDREN

We do not collect personal information directly from children. Bookings that include passengers under 18 must be made by a parent, guardian, or responsible adult, who is responsible for providing any information we need in order to carry that child safely.

Because we do not keep a passenger list, we do not ordinarily hold any information about children who travel with us at all.

We are particularly careful with images of children. We will not use an image in which a child is identifiable in any marketing material without the express consent of their parent or guardian.

10.COMPLAINTS

If you think we have mishandled your personal information, please contact us first so we can try to resolve it:

11.VISITORS FROM OVERSEAS

We are an Australian business operating in Tasmania. We do not direct our services at customers in any particular overseas country, and we handle all personal information under Australian law.

We welcome guests from all over the world. Wherever you are from, the rights described in Section 7, to access your information, correct it, ask us to delete it, and opt out of marketing, are available to you.

We may update this policy from time to time. This is version 1.0, effective 14 July 2026.
